Terms of Service

1. About KayaRx

Kayarx LLC, a Massachusetts limited liability company ("KayaRx," "we," "our"), operates the website kayarx.com and the related customer portal (the "Service"). KayaRx is a technology platform that connects customers with independent licensed physicians through our clinical partner's network. KayaRx does not itself provide medical care, prescribe medication, or render clinical opinions.

2. Eligibility

To use the Service you must be at least 18 years old, a resident of the United States, and able to enter a binding contract. You may not use the Service if you have been previously suspended or removed.

3. The Service

The Service allows you to create an account, complete a health intake, have your answers reviewed by a licensed physician, and — if the physician issues a prescription — have a compounded medication shipped to you by a licensed U.S. compounding pharmacy. Lab work, when required, is handled through at-home kits provided by independent labs. KayaRx operates the customer-facing surface; clinical decisions are the sole responsibility of the prescribing physician.

4. No medical advice

Information on kayarx.com is for general informational purposes only and is not medical advice. Always seek the advice of a qualified clinician with any questions about your health. The Service is not appropriate for medical emergencies — call 911 or go to the nearest emergency department.

5. No guarantee of approval or outcome

Submitting an intake does not guarantee that you will be prescribed any medication. Independent physicians may decline an intake at their sole clinical discretion. Where a prescription is issued, individual results vary. We make no promises regarding efficacy, side effects, or specific outcomes.

6. Compounded medications

Several KayaRx products use medications compounded by licensed U.S. compounding pharmacies. Compounded medications are not FDA-approved as finished drug products. They are personalized formulations prescribed by a licensed physician for a specific patient. Where a brand-name FDA-approved alternative exists, we will tell you so on the relevant product page.

7. Subscription, billing, and cancellation

Subscriptions auto-renew monthly until cancelled. Cancel anytime from your account dashboard — no phone call required, no fee. If a shipment has already left the pharmacy at the time you cancel, that shipment is non-refundable; future shipments will not be charged. Disputed charges should be raised with us first before initiating a chargeback.

8. Your account

You are responsible for keeping your login credentials confidential and for all activity on your account. Notify us immediately if you suspect unauthorized access.

9. Acceptable use

You may not misrepresent your identity, attempt to obtain medication for someone other than yourself, attempt to circumvent the verification or intake-review processes, or use the Service to procure medication you intend to resell.

10. Intellectual property

All content, software, branding, and design elements of the Service belong to KayaRx or its licensors. You receive a limited, revocable license to use the Service for your personal, non-commercial use only.

11. Disclaimer of warranties; limitation of liability

The Service is provided "as is" and "as available." To the maximum extent permitted by law, KayaRx disclaims all warranties, express or implied. KayaRx's aggregate liability arising out of these Terms is limited to the amounts you have paid KayaRx in the twelve months preceding the claim. Nothing in this section limits liability where law prohibits such limitation.

12. Dispute resolution

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of laws principles. Any dispute will be resolved by binding arbitration in Suffolk County, Massachusetts, except that either party may bring an individual action in small-claims court. You waive the right to participate in a class action.

13. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use of the Service after a change constitutes acceptance of the updated Terms.
